Project Responsibilities
1. Customer Responsibilities during construction:
The homeowner is responsible for navigating the approval process of their homeowner’s association, termite treatment, sod replacement, moving or repair of irrigation, providing gas hookup if installing a gas heater, and filling of the pool.
2. What are Yin Yang Custom Pools, Inc.’s responsibilities during construction?
We are responsible for all permitting, calling in of inspections, scheduling crews, verifying all measurements, clean up of job site, repair any concrete damage done to sidewalks or driveways, pool startup, and pool school instruction.
Swimming Pool Maintenance
1. Are start up chemicals included in the cost of my new swimming pool?
Yes. The chemicals needed for the initial start up are included in the cost of your new swimming pool. You, however, must arrange to buy any additional chemicals needed for the on going maintenance of your pool. There are also, many well qualified pool cleaning services in central Florida and we would be honored to assist you in locating the best service for your area.
2. I don’t understand the swimming pool equipment, what do I do if I need help?
After the initial start up, you will go through an extensive “Pool School”. This instructional class will take approximately an hour (depending on your questions) and will give you all the information that you will need to professionally manage and maintain your swimming pool…including the equipment. Should you “forget” or need additional help later we suggest you consult a qualified pool service company or pool supply center for assistance with the specific maintenance issues and requirements regarding your pool.
Warranties / Guarantees
1. Will my warranties be in writing?
Yes. Yin Yang Custom Pools, Inc. warrants that pools constructed by us shall be structurally sound for so long as the original Owner owns the swimming pool. As used in this context, “Structurally Sound” shall mean that the pool is capable of containing and materially holding water. In the event of its failure to do so, except as otherwise hereafter provided in any Swimming Pool Construction Agreement, we will repair the pool so that it will be capable of containing materially holding water. This limited structural warranty is limited to a period of one year for swimming pools and/or spas constructed under agreements with building contractors and/or developers who intend to sell the home and pool/spa to others. Our one year warranty also includes tile, interior finish, filter, pump and motor, time clock, automatic pool cleaner, chlorinator, heater, skimmer, pool piping, fittings and valves, pool light (except bulbs), transformer, steps, ladder, handrails, grab rails, and such additional equipment as we may install at the time of construction of the pool. Our obligation is limited to correcting any defects in materials, labor or workmanship at our expense. Some items of equipment installed by us have longer warranty periods that are offered directly by the manufacturer.
2. What are the major exclusions in your warranties?
Our warranty applies only if the pool, its equipment, appurtenances and accessories are used in accordance with the manufacturer’s specifications and/or our recommendations. We will not be responsible for any damage occurring to the pool resulting from the process of installation and/or presence of decks, walks or other items that were installed by others, nor shall we be responsible for normal wear and tear, settlement cracks, hairline cracks, discoloration, staining, rust corrosion, oxidation, patio cracks or deck cracks as all of the foregoing are commonly due to factors beyond our control. We shall not be responsible for flotation of pool (except where floatation occurs during our work and floatation is caused solely by our improper work) due to external water or by the pool being permitted to remain empty or partially empty, or for any other cause.
3. How much and what types of insurance does Yin Yang Custom Pools, Inc. have in place?
Because Yin Yang Custom Pools, Inc. is a Commercial/Residential swimming pool and spa builder, and Certified General Contractor we currently carry multiple lines of General Liability insurances, workers compensation insurance as required by Florida law, key person life insurance, key person AD&D insurance, corporate health insurance, property insurance and corporate automobile insurance. Who Obtains the Building Permit?
It is our responsibility to apply and obtain a building permit before construction begins. We work closely with all local municipalities to be sure we are up to date with their requirements for pool construction.
